一、茲以公立學校教職員退休資遣撫卹條例第100條已明定原學校教職員撫卹條例自107年7月1日起不再適用，且該條例於108年4月24日公布廢止，致旨揭規定已失其法令依據，且無單獨施行之必要，爰予以廢止。
