一、查教育部113年8月9日臺教授國字第1130088988號函略以，私立中小學教師轉任公立中小學教師，並取得較高學歷者，其依待遇條例第11條第2項第1款規定核敘薪級時，如因受所聘職務等級最高本薪之限制，致其所敘薪級低於私立中小學最後在職時敘定有案薪級者，得先依較高學歷改敘，再依同條例第9條規定採計職前年資。
二、綜上，旨揭函釋係該部就教師待遇條例所為之釋示，係闡明法規之原意，固應自法規施行日起有其適用。
