銓敘部令以，由立法委員、直轄市議會議員、縣（市）議會議員及立法院各黨（政）團等，依法遴選、聘用之公費助理服務年資，如屬全時專任性質者，自112年2月16日起，得採計為公務人員休假年資；另歷次解釋與旨揭令釋未合部分，自同年2月16日起停止適用。
