查勞動部110年4月13日勞動條4字第1100130213號函釋略以，性別工作平等法第15條第5項規定，受僱者於其配偶分娩時，雇主應給予陪產假5日。受僱者之配偶於境外生產，既有分娩事實，而陪伴方式多元，縱受僱者未離境，仍可請陪產假。茲以教育人員為性別工作平等法適用對象，是如有上開情事，亦得申請陪產假。
