| 主旨： | 轉知教育部重申有關公立高級中等以下學校教師成績考核辦法（以下稱考核辦法）第6條之1規定，「必要時」得派校外人員調查之適用原則，請查照。 |
| 說明： |
| 一、 | 依據教育部115年4月29日臺教授國字第1156001108號函及本局115年2月11日桃教高字第1150013117號函（諒達）辦理。 |
| 二、 | 按前開本局函轉教育部115年2月5日臺教授國部字第1156000120號函示說明三（三）3略以，檢舉案件如依高級中等以下學校教師解聘不續聘停聘或資遣辦法第9條之1或第13條第2項，認定行為人涉及教師懲處情形者，學校應派校內人員調查為原則，必要時得派校外人員調查。又所謂「必要時」，係指學校遇有特殊情形，例如因行政程序法迴避等事由，難以由校內人員進行調查時，始得委派校外人員調查。 |
| 三、 | 綜上，請各校依上開說明辦理，教育部將持續追蹤實務執行情形。 |
