| 一、 | 依教育部114年6月16日臺教人(二)字第1140056959號書函辦理，並檢附原函1份。 |
| 二、 | 查教育部114年5月14日臺教人(二)字第1140041480A號令釋，核釋公立高級中等以下學校教師曾任公立幼兒（稚）園代理教師且服務成績優良之年資，為待遇條例第9條第1項第4款所定經本部認定等級相當之服務年資，另教育部89年1月10日書函與上開令釋未合部分，自該日（114年5月14日）起停止適用。 |
| 三、 | 復查司法院釋字第287號解釋略以，後釋示如與前釋示不一致時，......除前釋示確有違法之情形外，為維持法律秩序之安定，應不受後釋示之影響。 |
| 四、 | 據上，教育部114年5月14日臺教人(二)字第1140041480A號令釋發布前，公立學校初任教師到職時依該部89年1月10日函釋所敘薪級已確定者，尚無從重新敘定薪級。 |
