選舉區外之機關、學校、團體、事業機構員工依規定不放假，但戶籍設在選舉區並具投票權者，得比照選舉區內員工投票日放假之規定辦理。至適用勞動基準法之勞工，其放假及工資給付等事項，仍請依主管機關勞動部之規定辦理。
