茲以「防疫隔離假」係為防疫應變緊急處置之特別措施，既有支薪，機關同仁於請防疫隔離假期間，倘機關基於公務需要，自得在兼顧防疫及維持政府持續運作前提下，視業務性質、資（通）訊設備狀況及人力配置指派同仁於上班時間居家辦公。於該上班時間執行職務，並未符合公務人員保障法第23條規定：「公務人員經指派於上班時間以外執行職務者，服務機關應給予加班費、補休假、獎勵或其他相當之補償」所稱加班之要件。
